Los Angeles Breath Alcohol Federal DOT Testing

Federal testing regulations require that an evidential breath testing device (EBT) approved by NHTSA be used for alcohol testing. This machine must be operated by a trained breath alcohol technician (BAT) following the procedures set forth in CFR 40 Subpart C.

When To Use Breathalyzer Tests

The rules allow for screening tests to be conducted using saliva devices or breath testing using evidential breath testing (EBT) and non-evidential breath testing devices approved by the National Highway Traffic Safety Administration (NHTSA).

The driver and the individual conducting the confirmation breathalyzer test (called a breath alcohol technician (BAT) complete the alcohol testing form to ensure that the results are properly recorded. The confirmation test, if required, must be conducted using an EBT that prints out the results, date and time, a sequential test number, and the name and serial number of the EBT to ensure the reliability of the results. A. Alcohol testing can be done with through a breath test, a urine test, or a hair test.
FAQ Can a DOT-regulated commercial motor vehicle driver use a prescription and still perform safety-sensitive duties?
A. Yes, under certain circumstances and as long as the prescription in question is not methadone. Regulations state that, 'A person is physically qualified to drive a CMV if that person does not use a controlled substance. A driver may use such a substance or drug, if the substance or drug is prescribed by a licensed medical practitioner who is familiar with the driver's medical history and assigned duties; and has advised the driver that the prescribed substance or drug will not adversely affect the driver's ability to safely operate a CMV. This exception does not apply to methadone.'
